2. Products and Services
Avigael Creation offers artistic products and services including, among other things, original artwork, hand-painted silk products, art prints, Judaica, personalized and custom-made items, and creative workshops.
Many Avigael Creation products are handmade. Slight variations in color, texture, brushwork, dimensions or appearance may therefore occur and are part of the handmade nature of the product.
Colors may also appear slightly different depending on the customer’s screen or device.
3. Prices and Payment
Prices displayed on the website are shown in the currency indicated on the relevant product page or checkout page.
Payment may be made using the payment methods available at checkout, including credit card and/or third-party payment providers such as PayPal or other payment processors.
Avigael Creation does not normally receive or store the customer’s complete credit-card details. Payment information is processed by the relevant payment provider.
An order is considered confirmed once payment has been successfully authorized and the customer receives an order confirmation.
4. Minimum Age for Purchases
Purchases and payments made through the website may only be made by persons aged 18 years or older.
The age restriction relates to entering into the purchase and payment transaction and does not prevent persons under 18 from browsing the website.
By placing an order, the customer confirms that they are at least 18 years old and legally capable of entering into the transaction.
5. Shipping and Delivery
Orders are shipped from Jerusalem, Israel.
Shipping methods and costs may vary according to the product, destination, package size and delivery method selected or offered at checkout.
The customer is responsible for providing a complete and accurate delivery address. Avigael Creation cannot be held responsible for delays or failed deliveries resulting from incorrect or incomplete information provided by the customer.
Processing Times
Processing times may vary depending on the type of product.
Ready-made items generally require less preparation time than personalized, made-to-order or hand-painted items.
Where a specific production or delivery timeframe is displayed on the product page, agreed upon for a custom order, or communicated to the customer before purchase, that timeframe forms part of the order.
Maximum Delivery Time
Unless another timeframe has been specifically agreed with the customer before purchase, the maximum delivery timeframe from the date of purchase is: 30 business days.
This timeframe includes production/processing and transportation to the destination.
Delivery times may be affected by circumstances outside Avigael Creation’s reasonable control, including customs procedures, postal or courier delays, strikes, security situations, natural events or other force majeure events.
For international orders, the customer may be responsible for customs duties, import taxes or other local charges imposed by the destination country.
6. Personalized and Custom-Made Orders
Products created according to the customer’s specifications, including personalized text, names, colors, dimensions, artwork or other individual requests, are considered personalized or custom-made products.
Because work may begin specifically for the individual customer, cancellation rights for these products may differ from those applicable to standard products.
Cancellation of custom-made products will be handled in accordance with applicable Israeli consumer law.
Where applicable, a custom-made order may be cancelled during the statutory period before production has begun. Once production has started, the right to cancel may be limited in accordance with applicable law.
For commissioned artwork or other projects requiring a deposit, any specific payment schedule agreed with the customer forms part of the order terms.
7. Cancellation of Online Transactions
Cancellation of transactions will be handled in accordance with the Israeli Consumer Protection Law, 1981, and applicable regulations.
Where the statutory right of cancellation applies to a distance-selling transaction, the customer may generally notify Avigael Creation of cancellation within the statutory cancellation period.

Where permitted by law, Avigael Creation may charge a cancellation fee of up to 5% of the transaction value or NIS 100, whichever is lower.
No such cancellation fee will be charged where cancellation results from a defect, a material discrepancy between the product and its description, failure to deliver within the agreed timeframe, or another circumstance in which charging such a fee is prohibited by law.
Nothing in these Terms limits any mandatory consumer rights granted by applicable law.
8. Returns
Where the customer is legally entitled to return a product following cancellation, the product must be returned to:

Customers should keep their receipt, order confirmation or other proof of purchase.
Unless otherwise required by law, the customer is responsible for returning the product to Avigael Creation and for the associated return shipping costs.
Where the return results from a defective product, an incorrect product, a material discrepancy from the order, or failure by Avigael Creation to supply the product as agreed, return arrangements and costs will be handled in accordance with applicable law.
Avigael Creation reserves any rights available under applicable law where a returned product has suffered a significant reduction in value as a result of damage or improper use.
9. Refunds
Once a valid cancellation or return has been approved, the refund will be processed in accordance with applicable law.
Where Israeli consumer legislation requires a refund following cancellation of a distance-selling transaction, the refund will be processed within the legally required period.
Refunds will normally be issued using the original payment method.
The time required for the refunded amount to appear in the customer’s account may also depend on the customer’s bank, credit-card company or payment provider.

Availability of replacement products cannot be guaranteed, particularly for unique, original, hand-painted or limited-edition pieces.
Shipping charges relating to voluntary exchanges may be charged to the customer unless otherwise agreed or required by law.
11. Sale and Discounted Items
Promotional, sale and discounted products remain subject to any mandatory cancellation, return or refund rights granted by applicable law.
Avigael Creation may limit any additional voluntary exchange or return policy for discounted products where legally permitted.
12. Workshops and Services
Workshop bookings and other services purchased through the website are subject to the cancellation provisions applicable to services and leisure/recreation activities under Israeli consumer law.
Where applicable to an online booking, statutory cancellation rights may depend both on the date on which the booking was made and on the amount of time remaining before the workshop or service.
Any additional or more favorable cancellation policy specifically stated on the workshop booking page or agreed with the customer will also apply.
If Avigael Creation cancels a workshop, amounts paid for the cancelled workshop will be refunded or, with the customer’s agreement, transferred to another available date.
13. Intellectual Property
Unless otherwise stated, all artwork, photographs, illustrations, patterns, designs, graphics, texts, logos and other creative content appearing on the website are owned by Avigael Creation or used with authorization.
Purchasing an original artwork, print or other product does not transfer copyright or reproduction rights to the purchaser.
Content and artwork may not be copied, reproduced, commercially used, modified, distributed or used to create derivative products without prior written permission from Avigael Creation.
14. Website Availability
Avigael Creation makes reasonable efforts to maintain accurate information and continuous operation of the website.
However, uninterrupted or error-free operation cannot be guaranteed.
The website may occasionally be unavailable due to maintenance, technical problems, hosting issues, third-party services or circumstances outside our reasonable control.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Avigael Creation and its representatives will not be liable for indirect, incidental, consequential or special damages arising from the use of the website or from products or services purchased through it.
Avigael Creation will not be responsible for damage resulting from improper use of a product, failure to follow care instructions, unauthorized modification of a product, or circumstances outside its reasonable control.
Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited under applicable law.
16. Force Majeure
Avigael Creation will not be liable for delays or failure to perform obligations resulting from circumstances outside its reasonable control, including war, security events, strikes, transport interruptions, natural disasters, government restrictions, customs delays or failures of third-party service providers.
Where such circumstances occur, reasonable efforts will be made to complete the order or find an appropriate solution.

The version applicable to an order will normally be the version in effect at the time the order is placed, subject to mandatory provisions of applicable law.

These Terms & Conditions are governed by the laws of the State of Israel.
Any dispute will be subject to the competent courts in Israel, subject to any mandatory jurisdiction or consumer protection provisions that apply.
